These Terms & Conditions govern the use of this website and the purchase of original artworks and fine art prints offered through the online store.
By placing an order through this website, you agree to these Terms & Conditions together with our Returns & Refunds Policy and Privacy Policy. Nothing in these Terms & Conditions excludes or limits any mandatory consumer rights that cannot lawfully be excluded or limited.
1. Seller
This website and online store are operated by Irina Myassoyedova, an artist and individual entrepreneur registered in the Republic of Kazakhstan.
Products offered through this website include original artworks and limited-edition fine art prints created or authorised by the artist.

2. Products and Artwork Information
We take reasonable care to ensure that product descriptions, dimensions, materials, edition information, photographs and other details displayed on the website are accurate.
Original artworks are unique handmade works. Natural variations in texture, surface, brushwork, relief, materials and other characteristics are part of the individual nature of an original artwork and are not manufacturing defects.
Fine art prints are produced according to the specifications stated on the relevant product page. Where a print is offered as a limited edition, the edition size will be stated on the product page. Each limited-edition print will be signed and numbered by the artist where stated in the product description.
Where a Certificate of Authenticity is stated as included, it will accompany the relevant artwork or print.
Colours displayed on screens may vary slightly depending on the device, display settings and lighting conditions. Such minor variations do not affect any mandatory rights where an item is materially different from its description.
3. Prices
Prices are displayed in the currency indicated on the website or at checkout.
The price applicable to an order is the price displayed and confirmed at the time the order is placed, subject to correction of obvious errors where permitted by applicable law.
Any delivery charges, taxes or other amounts collected by us will be shown before the order is completed where required by applicable law.
For international orders, additional customs duties, import taxes, brokerage fees or other charges may be imposed by the destination country or third parties. Unless otherwise stated at checkout or required by applicable law, these charges are the responsibility of the recipient.
Currency conversion rates and any foreign transaction or banking fees charged by the buyer’s bank, card issuer or payment provider are outside our control.
4. Orders
Before placing an order, you are responsible for reviewing the product information, price, delivery information and these Terms & Conditions.
You must provide complete and accurate billing, shipping and contact information.
After an order is submitted, an order or payment confirmation may be sent electronically. The point at which a legally binding sales contract is formed will be determined in accordance with applicable law.
Where permitted by applicable law, we reserve the right to refuse or cancel an order before dispatch if the item is unavailable, an obvious pricing or technical error has occurred, payment cannot be verified, fraud or unauthorised activity is reasonably suspected, delivery to the requested destination is unavailable or restricted, or fulfilling the order would violate applicable law.
If we cancel an order after payment has been received, amounts paid to us for the cancelled order will be refunded in accordance with applicable law.
5. Payment
Payment must be made using one of the payment methods made available at checkout.
Payments may be processed by independent third-party payment providers. We do not directly store complete credit or debit card details.
An order may be subject to payment verification and fraud-prevention checks by the relevant payment provider.
The buyer is responsible for ensuring that they are authorised to use the payment method provided.
6. International Shipping and Delivery
We offer international shipping to destinations that can reasonably and lawfully be served by the available shipping provider.
Available delivery methods, applicable shipping charges and relevant delivery information will be shown at checkout or otherwise communicated before the purchase is completed where required by applicable law.
Original artworks and fine art prints may require different shipping methods, packaging, insurance or export procedures.
Delivery times are estimates unless expressly stated otherwise or unless applicable law requires delivery within a particular period. International delivery may be affected by customs procedures, carrier delays, local import requirements, weather, security restrictions or other circumstances outside our reasonable control.
Nothing in this section limits any mandatory rights relating to delivery times or delayed delivery.
The buyer is responsible for providing a complete and accurate delivery address and for cooperating with reasonable customs or delivery requirements.
7. Customs, Duties and Import Requirements
International shipments may be subject to customs clearance, import duties, taxes, brokerage fees and other requirements imposed by the destination country.
Unless otherwise stated at checkout or required by applicable law, the recipient is responsible for import duties, taxes and other destination-country charges that are not collected by us at the time of purchase.
Customs authorities or shipping providers may request information or documentation from the recipient before releasing a shipment.
We are not responsible for delays caused solely by customs procedures or the recipient’s failure to provide information required by customs or the carrier, except to the extent responsibility cannot lawfully be excluded.
8. Packaging and Shipment of Artworks
Original artworks and fine art prints will be prepared for shipment using packaging appropriate to the nature of the work and the selected delivery method.
Depending on the artwork, destination and shipping method, an original artwork may be shipped stretched, unstretched or rolled where this is stated on the product page or communicated before purchase.
Insurance or enhanced carrier liability may be arranged where appropriate or where stated as part of the shipping service.
The buyer should retain all packaging until the artwork has been inspected after delivery.
9. Delivery and Risk
Risk of loss or damage will pass to the buyer at the time determined by applicable law.
Where mandatory consumer law provides that risk remains with the seller until the buyer or a person designated by the buyer receives physical possession of the goods, that rule will apply.
If a shipment appears damaged upon arrival, the buyer should, where reasonably possible, document the condition of the package before opening it and retain all packaging materials.

10. Cancellations, Returns and Refunds
Cancellations, returns and refunds are governed by our Returns & Refunds Policy and by any mandatory consumer rights applicable to the purchase.
For change-of-mind returns, the buyer may be responsible for the direct cost of returning the item where permitted by applicable law and where the buyer has been properly informed of that responsibility.
For artworks or other items that cannot normally be returned by regular post, international return shipping may be expensive. Where required by applicable law, information or an estimate concerning the direct cost of return will be provided before the order is placed.
Nothing in these Terms & Conditions or in our Returns & Refunds Policy excludes, restricts or limits any mandatory right of withdrawal, refund, repair, replacement or other remedy available under applicable consumer law.
11. Certificates of Authenticity
Where a Certificate of Authenticity is included with an original artwork or limited-edition fine art print, it forms part of the documentation accompanying the work.
The Certificate of Authenticity should be retained by the owner together with records relating to the purchase and provenance of the work.
A Certificate of Authenticity does not transfer copyright or other intellectual property rights in the artwork.
12. Copyright and Intellectual Property
All original artworks and original creative content displayed on this website are protected by applicable copyright and intellectual property laws.
Purchase of an original artwork or fine art print transfers ownership of the physical item purchased but does not transfer copyright, reproduction rights or other intellectual property rights in the underlying artwork unless expressly agreed in writing.
Except where permitted by applicable law, artworks and images may not be reproduced, copied, commercially exploited, licensed, distributed, used to create derivative commercial products or otherwise used for commercial purposes without prior written permission from the relevant copyright holder.
Nothing in these Terms & Conditions restricts any use that cannot lawfully be restricted under applicable copyright law.
13. Website Content
We take reasonable care to keep information on this website accurate and current. However, minor typographical, technical or display errors may occasionally occur.
We may update website content, product information or availability when reasonably necessary.
Nothing in this section permits us to alter the material terms of a completed purchase where doing so would violate applicable law or the agreed contract.
14. Privacy
Personal information is processed in accordance with our Privacy Policy and applicable data protection law.
Information necessary to process an order may be shared with payment providers, shipping carriers, customs authorities and other service providers where reasonably necessary to process payment, fulfil the order, arrange delivery, comply with legal obligations or prevent fraud.
15. Liability
Nothing in these Terms & Conditions excludes or limits liability, consumer rights or remedies that cannot lawfully be excluded or limited.
To the maximum extent permitted by applicable law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable at the time the contract was formed or for losses caused solely by circumstances outside our reasonable control.
Nothing in this section affects the buyer’s statutory rights in relation to goods that are damaged, defective, unsafe or not as described.
16. Events Outside Our Reasonable Control
We will not be responsible for a delay or failure to perform an obligation where and to the extent that the delay or failure results from circumstances outside our reasonable control, including significant transport disruption, customs restrictions, natural disasters, war, civil disturbance, government action or interruption of essential services.
If such circumstances materially prevent an order from being fulfilled, we will take reasonable steps to inform the buyer and will provide any cancellation, refund or other remedy required by applicable law.
17. Governing Law and Mandatory Consumer Protection
These Terms & Conditions and purchases made through this website are governed by the laws of the Republic of Kazakhstan, subject to any mandatory consumer protection rules that apply to a particular customer or transaction.
If mandatory laws applicable to a customer provide consumer rights or remedies that cannot lawfully be excluded by choosing another country’s law, those rights and remedies remain unaffected.
Nothing in these Terms & Conditions prevents a consumer from exercising any right to contact a competent consumer protection authority, alternative dispute resolution body or court where such right is provided by applicable law.
18. Changes to These Terms & Conditions
We may update these Terms & Conditions from time to time to reflect changes to the website, online store, business practices, shipping arrangements or applicable legal requirements.
The terms applicable to a purchase are the terms in effect when the relevant order is placed, except where a change is required by law.
19. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will apply only to the extent permitted by law and the remaining provisions will continue to apply.
